Employment Practices Liability Claims Process

Most dentists recognize that employees are their most valuable assets in running an efficient practice. However, those who are business owners or administrators are still vulnerable to allegations regarding employment practices.

If you’ve chosen the Employment Practices Liability endorsement to your TDIC Professional & Dental Business Liability policy, your coverage pays for defense costs, settlements and civil damages you might incur, and be legally obligated to pay, as a result of an actual or alleged wrongful employment act claimed by an employee or applicant.

Employment Practices Liability provides coverage for many types of claims, including: 

  • Sexual harassment
  • Discrimination
  • Wrongful termination
  • Negligent evaluation
  • Failure to employ or promote
  • Wrongful disciplinary action
  • Wrongful infliction of distress

However, it’s important to note that Employment Practices Liability does not cover wage-and-hour claims.

Reporting a claim

Once you submit your claim, a TDIC claims representative will contact you as soon as possible to gather any additional information, obtain a copy of employment records such as the personnel file and employee manual, and discuss the steps in the claims process to help you protect your interests.  

Understanding your coverage

Defense costs and paid indemnity reduce the limits of the policy, as both expenses and indemnity are paid out of the same limit. In other words, for each dollar spent on defending a claim reduces the amount available for settling or satisfying a judgement.
